These terms govern the use of the cloud-based platform for construction scheduling, resource management, and digital documentation. They apply to engineering firms and construction companies that use BauControl in the context of infrastructure projects.
BauControl provides web-based software that supports the planning, monitoring, and documentation of construction projects. The platform includes modules for resource planning, construction schedule control, material tracking, and a digital project file. The specific functions are determined by the respective scope of services booked and the current system documentation.
Users are responsible for the accuracy of the data entered into the system, the maintenance of master data, and compliance with operational requirements. Access credentials must be treated as confidential and must not be shared with unauthorized third parties. Changes to site plans and resource assignments must be recorded promptly so that project control is based on current values.
The platform serves as a support tool for project control. It does not replace the professional review by site managers, structural engineers, or project managers. The operator is not liable for damages arising from incorrect entries, incomplete data sets, or misuse of the software. Liability for intent and gross negligence remains unaffected.
All project-related documents, plans, and protocols are stored in the digital project file. The operator backs up the data regularly and ensures that the systems meet common security standards. Users have the option to create their own data backups. Retention periods are governed by the statutory requirements for construction documents.
The operator reserves the right to adjust these terms if this becomes necessary due to legal changes, new features, or technical developments. Users will be informed of significant changes by email. If the amended version is not objected to within four weeks, it is deemed accepted.
The use of BauControl can be terminated by either party with one month's notice to the end of the month. Upon termination, the stored project data will be exported at the user's request and subsequently deleted. Statutory retention obligations remain unaffected.
